General Terms and Conditions (GTC) for the Webshop decembermagic.com, Headquartered in Dubai
Scope
These General Terms and Conditions (hereinafter referred to as "GTC") govern the relationship between decembermagic.com (hereinafter referred to as the "Provider") and its customers (hereinafter referred to as the "Customer" or "Customers") in connection with the sale of digital products via the Provider's webshop.
Offer and Conclusion of Contract
The Provider’s offer is directed at anyone who wishes to purchase the product. The presentation of products in the webshop does not constitute a legally binding offer, but rather an invitation to place an order. The contract between the Customer and the Provider is concluded only when the Customer places an order and the Provider confirms it. The Provider reserves the right to reject orders without stating reasons.
Prices and Payment Terms
All prices listed in the Provider's webshop are in euros and include VAT. The Provider reserves the right to change prices at any time. The following payment methods are available: Twint, credit card, Apple Pay, Klarna, and PayPal. The Provider reserves the right to exclude certain payment methods. The Customer agrees to receive the link to the digital product immediately after completing the order via email.
Delivery
Since the products are digital, delivery is made by email at the end of November.
Right of Withdrawal
There is no right of withdrawal, as the products are digital goods.
Warranty and Liability
The Provider warrants that the digital products are free from material and manufacturing defects at the time of delivery. No further warranties are provided. The Provider is not liable for any damages resulting from improper use of the products by the Customer.
Data Protection
The Provider commits to treating the Customer’s personal data confidentially and using it solely for order processing purposes. The data will not be shared with third parties.
Applicable Law and Jurisdiction
Swiss law shall apply exclusively. The place of jurisdiction is the Provider’s registered office.
Severability Clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The parties shall replace the invalid provision with a legally permissible provision that most closely reflects the economic purpose of the invalid one.
